2.4 Good-Faith Statement

Your notification must include a statement substantially similar to the following:

“I have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”

2.5 Accuracy and Authority Statement

Your notification must also include a statement substantially similar to the following:

“The information in this notification is accurate, and under penalty of perjury, I am the copyright owner or I am authorized to act on behalf of the copyright owner.”

2.6 Signature

The notification must contain a physical or electronic signature of the copyright owner or an authorized representative.

For electronic submissions, typing your full legal name may serve as an electronic signature.

3. What Happens After We Receive a DMCA Notice

Once we receive a DMCA notification, we may review the submission to determine whether it contains the information required by applicable law.

Depending on the circumstances, we may:

  • Review the copyright complaint.
  • Request additional information if the notification is incomplete.
  • Remove or disable access to material identified in a valid infringement notification.
  • Notify the applicable user or content provider that material has been removed or disabled.
  • Take other appropriate action consistent with applicable law.

Submitting a DMCA notice does not automatically guarantee removal of material. We may require sufficient information to establish that the request is properly supported and complies with applicable legal requirements.

4. How to Submit a DMCA Counter-Notification

If you believe that material associated with you was removed or access was disabled because of a mistake or misidentification, you may submit a DMCA counter-notification to our designated agent.

A counter-notification should contain the following information:

4.1 Your Contact Information

Please provide:

  • Full legal name
  • Mailing address
  • Telephone number
  • Email address

4.2 Identification of the Removed Material

Identify the material that was removed or disabled and provide information regarding where the material appeared before it was removed or disabled.

Where applicable, include the original URL or other information that allows the material to be identified.

4.3 Good-Faith Statement

The counter-notification should include a statement substantially similar to:

“I have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.”

4.4 Consent to Jurisdiction

The counter-notification should include a statement substantially similar to:

“I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside the United States, the judicial district in which Alakh IPTV is located, and I will accept service of process from the person who provided the original DMCA notification or an agent of that person.”

4.5 Signature

The counter-notification must include a physical or electronic signature.

For electronic submissions, typing your full legal name may serve as an electronic signature.

5. Processing Counter-Notifications

After receiving a valid counter-notification, we may forward the counter-notification to the original complaining party.

If the original complainant does not notify us that they have filed a court action seeking an order to restrain the allegedly infringing activity, the material may be restored or access may be reinstated in accordance with the applicable requirements and timelines of the DMCA.

Where applicable, restoration may occur not less than 10 business days and no more than 14 business days after receipt of a valid counter-notification, unless otherwise required by law or circumstances.

6. Repeat Copyright Infringers

Alakh IPTV respects the rights of copyright owners and may take appropriate action against users who repeatedly engage in copyright infringement.

Where appropriate and consistent with applicable law, we may:

  • Issue warnings.
  • Remove or disable access to infringing material.
  • Restrict access to certain services or features.
  • Suspend or terminate accounts.
  • Take other appropriate measures against repeat infringers.

Our actions may depend on the circumstances of each case and applicable legal requirements.

7. False or Misleading DMCA Notices

Copyright owners and their authorized representatives should ensure that all information submitted in a DMCA notification is accurate and complete.

Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages.

Accordingly, please do not submit a DMCA notification unless you have a good-faith basis for believing that the material in question infringes your copyright.

8. Incomplete Notifications

If a DMCA notification or counter-notification does not contain sufficient information, we may request additional details before taking further action.

To avoid unnecessary delays, please ensure that your submission includes all applicable information described in this policy.

9. Third-Party Content

Alakh IPTV may provide access to or reference content, links, services, or information originating from third parties.

If your copyright concern relates to material controlled or hosted by a third party, you may also need to contact the applicable website, platform, hosting provider, or content provider directly.

Where appropriate, we may forward or direct the complainant to the relevant party responsible for the material.

10. Changes to This DMCA Policy

We may update or modify this DMCA Policy from time to time to reflect changes in applicable law, our services, or our procedures.
